    Abstract: 解僱保護制度一直都是勞動法中極重要之研究議題,解僱保護基本上是對抗雇主片面終止勞動關係之制度性力量。該制度本質上也是勞動市場安定制度之一部分,解僱保護制度之基礎部分便是由憲法中職業自由保障,其為憲法中對財產權保障之外,對於勞動、經濟生活(das Arbeits- und Wirtschaftsleben)最中心之基本原則規範(Grundsatznorm),以及對於自由之經濟活動( die freie wirtschaftliche Betätigung)最為重要之基本權。其所內涵之工作保障所表彰者不只是社會安定的元素,更在確立法定解僱保護之憲法基礎,其制度規範隱含勞動者本身對工作機會的需求,也具有勞動關係存續保障不可或缺的制度性功能。\\r 當勞工不受勞動法上之解僱保護制度保障時,如德國之僱用五人以下員工之小企業,亦或是如我國因其特性將中央主管機關指定公告不適用勞動基準法之部分行業或工作。其是否便無任何解僱保護。還是由憲法中亦可導出最低限度保護(Mindestschutz),而透過其他法律規章加以保障。此處德國學界一致認同最低限度解僱保護之存在,此處係由立法者有自由形成之空間並配以私法上概括化條款(Generalklause)之收容性功能(Auffangsfunktion)而形成解僱保護次級之保障。\\r 除了個別解僱保護外,亦有所謂大量解僱保護,由我國大量解僱保護法第一條之立法目的來看,其言明基於憲法之規定,保障人民之生存權、工作權及財產權,避免事業單位大量解僱勞工時,對社會造成衝擊,損害勞工權益。亦即適當調和憲法中職業自由工作權、財產權及生存權,但是於條文係規定「保障勞工工作權及調和雇主經營權……」。首先必須釐清者,一般解僱保護與大量解僱保護在憲法層次上之保障強度及其基礎有無不同。而本文將就德國與我國在憲法上、民法上及大量解僱保護法制中之相關規定作出整體性之研究,以供我國將來修改解僱保護法制之參考。\\r
    The System of the protection against unlawful dismissal is always fast the most important issue in Labor law. The problem of Mass Redundancy of Employees is real difficult to find a fair solution.\\r This Study first is going to introduce and analyze the German System of the protection against unlawful dismissal for its original thought, principal goal and major content. Then this research will introduce the legal framework of the Protective Act for Mass Redundancy of Employees. In the end, this Study is going point out, that Taiwan should fine its own way of the System of the protection against unlawful dismissal for its next generation.
