    Abstract: 性別平等原則的落實已成為我國近年來親屬法發展的主軸之一。本文檢視近年來民法親屬編之修正後發現,立法者的主要作法乃是將條文中性化(去性別化),明訂夫妻享有同等之權利義務,並規定雙方以協議方式共享決策權。不過,父權體制對台灣社會仍然具有普遍而強大的影響力,因此親屬法之修正雖有宣示的正面效果,但對於撼動根深蒂固的性別刻板印象而言,效果可能相當有限。本文認為,為避免法律制度對於促進性別平等的努力流於形式,親屬法修正的另一個(或下一個)發展方向,應在於正面積極挑戰父權體制的根本結構。本文建議重新型塑傳統上支撐父權體制的兩個主要制度:婚姻與家庭制度。藉由法律規範重新定義婚姻與家庭制度以稀釋其所承載的性別意涵,並減緩其對於性別刻板印象的支持與複製功效。本文相信,當性別刻板印象漸漸失所依附,父權體制的支持系統漸漸崩解之時,性別平等原則才有真正落實的可能。
    Gender equality has been one of the driving forces behind family law reform in Taiwan. The new family law no longer recognizes or reinforces patriarchal family practices. It instead uses gender neutral language and requires married couples to share decision-making power. However, the traditional patriarchal norms and practices still have great influence on the Taiwanese family and society. Operating in the shadow of the patriarchal system, the new family law alone might not be able to help foster egalitarian marital relations and society as the legislators and reformers had hoped. The author suggests that the next step of the legal reform should aim to deconstruct the patriarchal system by redefining the two underpinning institutions of the patriarchal system: marriage and family.
