    Abstract: 青少年網咖熱是台灣社會的新興現象,面對這個現象,成人社會祭出法規範的強硬規制手段,以緩解此一熱潮。台北市政府率先訂定了「台北市資訊休閒服務業管理自治條例」,中央政府的「資訊休閒服務業管理條例草案」亦於立法院審議當中。這兩部法令固然獲取(或即將獲取)民意機關的認可,然其正當性並非就此確然毫無疑問。如果所有的國家權力行使都必須接受憲法的檢驗,則管理網咖的法令自然不能例外。因此,本文要從青少年基本權的憲法保障切入,辨證網咖法令的合憲性,嘗試對於此一公共政策的立法爭議,提出合於法釋義學要求的理性分析。本文的基本主張為:透過現行法令的確切執行,以及各種行政規制手段的靈活運用,即足以達成保護青少年身體不受傷害權的原始目標,另立新法管理網咖實非必要之舉,反而將造成青少年人格權的過度侵害,而且有違憲之虞。事實上,若非以完成立法顯示國家對於青少年網咖熱的關心,則應儘量避免某些合憲性頗富疑義的規制內容,否則同樣將釀成過度侵害青少年人格權的惡果。
    The Cyber Café is one of the most noticeable phenomena of Taiwanese society in the 21 century. Because of its potential harm to teenagers, the Taipei City Government has imposed legislated to control the vile environment of Cyber Cafés. But this regulation is still subject to constitutional review, even though it has been passed by the City Council. According to the principle of the “Rule of Law”, democracy is not the only value in our public policy, and human rights play a more important role. This article tries to build a definite normative relation between the regulation of Cyber Cafés and the basic rights of teenagers. The basic rights of teenagers have not received enough respect through this regulation, and the author has pointed out its error and misconstruing of Liberalism. Two conclusions ensue after the discussion. First, this regulation is not a necessity to protect teenagers from relevant harm, because the Taipei City Government still has other regulative tools to accomplish the same goal, Second, some contents of this regulation impose restrictions on the basic rights of teenagers that are too severe.
