    Abstract: 本文以現行監察院之各項主要職權與清代都察院之職權做比較分析。全文共約十萬字
    ，分為六章：第一章「緒論」分兩節就歷代御史制度及民國成立以來之監察制度探討
    清代都察院與現行監察院建制之背景。第二章「清代都察院之組織與職權」，將都察
    院之組織，監察御史之職掌與六科給事中之職掌分三節述。第三章「當前監察院之組
    織與職權」，分別就法律性及政治性權力比較二者相異之職權。第四章「清代都察院
    與當前監察院相祑之職權」，分別就法律性及政治性權力比較二者相異之職權。第五
    章「清代都察院與當前監察院相似之職權」則就二者共有之重要的糾彈性權力及政治
    性權力分析其異同。第六章「結論」則就比較之結果略論現行之監察制度與傳統監察
    制度相互影響，修正之處，並進而探究強化監察權應循之方向。
