Abstract:	第一章為緒論，簡述寫作動機，信用狀基本功能乃所可能面臨之危機─假單據。第二章為信用狀基本性質與銀行對單據的處理，主要論述信用狀之文義與獨立抽象性，及此基本原則之例外使用。又銀行於處理正常單據所應盡之義務與應享之權利。第三章為假單據與銀行之責任。首先對於假單據（詐欺）之範圍與定義做一概述，再次討論銀行於處理假單據時，學者所持的看法與判例之支持。第四章為當事人基於詐欺等違法行為之救濟。主要介紹英美法系之禁制令（injunction）及運用上之效力，並兼論大陸法系之保全程序是否在詐欺行為上亦有適用性，最後為結論與建議、附論應如何預防不實之交易行為，以期對從事實務者有所俾益。
