    Abstract: 著作權侵害的認定是法院在許多著作權訴訟中所必須面對的難題,亦是著作權侵 權責任成立之前提,目前國內法院受到美國法的影響,多以「接觸」及「實質近似」兩個 要件認定抄襲或著作權侵害,該二要件看似明確,但在實際操作的過程中,卻有相當 高度的不確定性,以「接觸」要件而言,我國及美國實務均非要求原告須提出直接證 據證明之,只要能以間接證據證明「接觸之可能」即可,此即我國實務所稱之「間接 接觸」,但是該等關於「間接接觸」之間接證據究竟要達到何種心證程度,才足以推論 成立「接觸」,卻常是訴訟爭議的核心;在判斷「實質近似」時,我國及美國實務將其 區分為「量」與「質」之考量,但我國實務在「量」及「質」的「實質近似」判斷上, 似仍不夠細緻。 本研究計畫之主要目的在於以嚴謹的學術方法,透過對我國實務見解的通盤整理 檢討,並探究影響我國著作權侵害認定實務甚鉅的美國法之實際操作標準及該國相關 的實務學術爭議,並配合我國特有之著作權法制環境(特別是大範圍的刑事責任),對 我國未來法院操作著作權侵害認定之標準提出具體建議,此等具體建議不僅是針對一 般性的「接觸」與「實質近似」標準,及實際認定時所使用之「潛意識模仿」、「整體觀 念與感覺」等衍生標準,也針對不同類型的著作(如電腦字型、電腦軟體程式、美術 著作、音樂著作及故事情節等),在侵害認定上提供具體的建議。
    The establishment of copyright infringement is occasionally a controversial issue in copyright litigation. Being influenced by the U.S. court decisions, more and more Taiwan court ask the plaintiff to prove that: (1) the defendant had “access: to plaintiff’s copyrighted work, and that (2) defendant’s infringing work is “substantially similar” to plaintiff’s copyrighted work. Nevertheless, the requirements of “access” and “substantial similarity” are not quite clear in Taiwan court decisions. Although neither the U.S. nor the Taiwan courts requires the plaintiff provide direct evidence concerning “access,” it is difficult to evaluate how much indirect evidence the plaintiff needs to present in the court. As to the “substantial similarity” requirement, the Taiwan courts have not drawn a clear line of quantitative and qualitative analysis. This study will survey Taiwan court decisions relevant to copyright infringement in a systemic way. It will also analyze the U.S. court decisions and literature to understand the history, development, and criticism of the “access” and “substantial similarity” requirements. Moreover, this study will illustrate the policy issues resulting from implementing the U.S. standard into Taiwan`s copyright criminal liability. Finally, this study aims to provide concrete standard in finding copyright infringement in various copyrighted works (including but not limited to font, computer software, artistic work, music work, and story plot).
