Title:	民事既判力之研究

Abstract:	訴訟是為終局的解決紛爭的國家制度，對當事人的爭執，必須在一定的時點使其終結確定。訴訟自提起判決確定，其間各階段均可發生種種的效力，就終局判決而言，依其判決之宣示，對於法院發生拘束力力，判決之法院已不能隨意變更或撤銷已宣示之判決；當事人對於判決於不能為上訴時，其聲明不服之途徑已窮，判決即告確定，似此判決至於不能至於不能聲明不服，判決在程序上之效力，可構之為一形式之確定力」。又「形式之確定力」力「發生之結果，對判決之內容亦可生拘束力，而這種拘束力，因有關訴訟標的之實體關係，故可稱之為「標的之標的關係，質確定力」。既判力是確定判決對復訴之拘束力，而此拘束力究係實質的確定力的本身，或是基於實質的確定力而生之效力，或是對法院的拘束力及對當事人形式的確定力之延長，就要探究既判力之本質的問題，此在既判力學說上至今仍爭執未決。并且既判力在訢訟程序上所生之拘束力是就判決之何部分發生？對何種後訴發生？其效力應及於後訴請求之何部分？又其效力及於何人？採如何形態拘束後訴？凡此問題在既判力理論上均頗值探討。
