Title:	分期付價買賣契約之研究

Abstract:	分期付價買賣契約之研究分期付價買賣,乃約定出賣人先行交付標的物之占有於買受人，而價金則俟後分為若干定期支付之一種特殊形態的買賣契約。通常於契約中，多約定賣受人於支付第一期價金後，賣受人即對標的物有占有使用權；惟於買受人權；惟於買受人支付全部價金前，標的物之所有權仍由出賣人。此種特形態的買契約，在現今工商社會上，甚為普遍施行。此種買賣，不僅考慮到買受人之經濟能力，且兼顧及出賣人之權益，買受人從而提高生活水準，出賣人亦因擴銷產品而使業務蒸蒸日上。在供與需之協調上，此種買賣對於國計民生之富足與社會經濟之繁榮，確具有莫大之貢獻。當今歐美日本等工業先進國冢，其分期付償買賣之發達，自不待言；准已由傳統之分期付價買賣制度演進至現代化之融資分期付價買賣制度，即由銀行等金融機搆在獲得某項擔保之餘，予融資於出賣人或買受人，而介入分期付價買賣之法律關係。在資金之週轉上，此種融資分期付價買賣制度予當事人以莫大之方便，不失良制。
