Title:	海陸空貨物運送人責任之比較研究

Abstract:	運送契約成立後，運送人有按契約之本旨將運送貨物運達目的地之義務，若貨物於運送過程中發生毀損滅失或遲延之損害，則發生運送人之責任問題。所謾「運送人之責任」，係指依運送法上之規定，運送人對於貨物之損害必須負擔損害賠償之責任而言。因此，運送法上運送人之責任制度、負責事由，免實事由、免實文句、賠償範圍，以及責任消滅等有關規定如何方能兼顧雙方當事人之利益，公平持正無所偏頗，洵實有詳加析述比較之必要。且運送依其所利用之空間區分，可分為海運、陸運及空運三種。由於交通事業之突飛猛進，託運人之託運貨物，已不侷限於海運、陸運或空運一種、當兼而之，故為解決運送法上之問題，若無將海陸空運送法之有關規定統一比較分析，實難達到解決訟爭之目的。因此，本文就現行有關海、陸、空運送法規作一通盤之研究，以期建立一完整之運送人責任之理論體系。
