Title:	原因自由行為原理之適用限制

Abstract:	甲女為乙男的國小低年級導師，國小畢業後兩人即未曾謀面。乙成年後，有酗酒習慣，但從未曾有對女性有酒後性侵情形。某日，二十六歲之乙於上午七時許先飲用啤酒四、五杯及約中午飲用高粱酒一百八十CC兩瓶後，色慾薰心，因得知七十五歲之甲獨居在家，竟萌生強制性交之犯意，於同日十四時五十分許，攀越甲住處外之木籬笆，侵入甲之住處後房間，將該房間門閂拴住，關掉該房間之電燈，徒手抓住甲之雙手，將甲強押至床上，乙再自行脫去自己之外褲及內褲，欲將其生殖器插入甲之性器；經甲極力掙扎及抵抗，乙仍罔顧兩人之師生情誼，強行將甲之內褲脫下，以手指插入甲之性器。嗣甲趁隙將乙踢開，逃至住處前房間內，將前房間之門窗均鎖上，欲阻擋乙並報警處理。詎乙仍承前強制性交之接續犯意，多次繞至前房間察看，並持甲住處內之剪刀破壞該處用以分隔前、後房間之滑門玻璃欲尋找甲，甲見狀旋即自前門逃出，直接前往警局報案。嗣經警於同日十五時三十分許，在甲住處發現乙下半身赤裸倒臥在前房間內睡覺，乙被警逮捕時，測得其吐氣酒精濃度高達每公升一•一五毫克。
