Title:	中國刑法百年發展的回顧與反思——以臺灣地區的幾個刑法議題為中心

Abstract:	自清末沈家本(1840-1913)主導修律開始,中國法制正式邁向了現代化的進程。在沈家本主導下所修之律法,盡管多數未及頒行,甚至尚處于草案階段,但仍然對此后中國法制產生了不容忽視的影響。其中的《大清新刑律》堪稱今日之臺灣地區刑法的基石。本文以臺灣地區的幾個刑法議題為例,觀其自《大清新刑律》以來之流變,略述其現今所引發之爭論,并稍作評議。這些議題包括:殺害直系血親尊親屬罪之存廢爭議、通奸罪之除罪化爭議、內亂罪之修正(加列須以暴力或強制為手段且已實施為要件)、臺灣地區戒嚴時期政治犯之平反與補償、死刑廢除之爭議。藉由對這些議題的審視,希望能對兩岸法制之發展有所裨益。
