Title:	律師我要怎麼付你錢？律師酬金的倫理規範

Abstract:	甲欲與其配偶乙離婚，委任A律師向法院提出離婚之訴，合併請求剩餘財產分配十萬元，並附帶請求法院酌定子女監護。關於收費方式，A原本希望與甲約定採取審級包審制，至一審終結為止收費六萬元，但甲覺得萬一敗訴的話還要給律師這麼多錢會划不來，所以跟A要求他先付四萬元，假設離婚之訴勝訴再付一萬元，剩餘財產分配全部勝訴再付一萬元，若法院酌定子女由他單獨監護，還會再加付一萬元。A算一算若是能全部勝訴，可以拿到七萬元比原本的六萬元還多，於是就答應甲。但是後來：由於家事事件在我國採取強制調解制度，在經歷兩次調解庭之後調解成立，除了剩餘財產分配未能取得之外，其餘調解結果都符合甲原本的希望。A律師依約向甲請求除了原本四萬元之外的後酬二萬元，沒想到甲不但嚴詞拒絕，甚至表示即使原本的四萬元A也應該至少退費一萬元還他，因為「從頭到尾都是調解委員在勸說在調停，你既不需要再寫狀也不需要幫我辯論，連對法官做陳述都不需要做，你憑什麼收我四萬元？」雙方因此爭執不休。
