    Title: 土污規制行政上法執行之實效性論議

    Abstract: 台灣於二○○○年制定施行「土壤及地下水污染整治法」，迄今已滿十四年。環保機關就土污責任人之不法行為，多半係以「命繳納整治費」或「科處罰鍰」等高權手段介入，有時甚以行政罰法第十八條第二項為依據加重科處罰鍰數額。政府為求土壤污染規制目的之達成，本可藉助行政制裁之手段予以落實；惟學理上有認為應考量如何擺脫過去法執行或行政制裁之舊思維，改以公私協力、自主規制、軟法治理等手段，方能取得最大公益效果。對此，本文將由土壤污染規制行政上法執行之實效性加以論議，於比較法上則以日本法為主，藉此供學術研究及實務發展之參考。
