    Abstract: 本文從歐盟國際私法之發展與其650/2012號繼承規則出發,討論兩岸國際私法相關規定。直接管轄,歐盟採取由被繼承人死亡時之慣居地法院管轄為原則,並有合意管轄與其他管轄之規定;原則上歐盟成員國所為之決定,在其他成員國均被承認。準據法上,歐盟得由當事人指定本國法為準據法,無指定則依慣居地法。兩岸並無關於直接管轄與間接管轄之規定,需由學理或實務補充;繼承準據法,中國大陸採慣居地法,臺灣採本國法。
