    Abstract: 原住民族權之立論基礎,為對原住民族集體與其土地之間先於現代國家出現前既已存在之特殊關係的承認,以及對這樣的關係之維護延續,因此,原住民族土地權的落實與否,自是保障原住民族權之關鍵。我國原住民族基本法通過後,確立了保障原住民族權的原則,但關於土地權利之落實,則與當前審議中之原住民族自治法(草案)與國土計畫法(草案)內容有很大的關係。本文:1) 回顧原住民族土地權之相關論述,指出原住民族土地權所包含之空間規劃、土地管理、資源利用等三個層面之權利及其意涵;2) 分析我國國土計畫之體系,說明原住民族自治和國土計畫之關係,以及他們所涉及原住民族土地之空間規劃、土地管理、資源利用事項;3) 分別就上述三個層面,探討原住民族自治所會面臨的法制問題;最後,本文並就如何透過原住民族自治法與國土計畫法內容之設計,達成原住民族土地權之落實,提出建議。
    The theories of indigenous rights are deeply based on the continuationand recognition of the relations between indigenous peoples and their lands. The realization of indigenous land rights therefore decides the success or failure of the protection of indigenous rights. In Taiwan, the Indigenous Peoples Basic Law passed in 2005 confirms the principles to protect indigenous rights. The realization of indigenous land rights is however depended on the proposed drafts of Indigenous Peoples Self-government Actand National Land Planning Act that are still in the legislative process. This paper: 1) reviews the indigenous land rights discourse, points out the aspects of spatial planning, land management, and resource utilization constitute indigenous land rights; 2) describes the national land planning regime in Taiwan, explores the relations between national land planning and indigenous self-governance, and examines indigenous land issues from the three aspects addressed above; 3) reveals the problems indigenous self-governance will face in the institutional infrastructure constructed by the proposed acts. In the end, this paper makes suggestions on the revision of current drafts to provide proper institutional infrastructure for the realization of indigenous land rights in Taiwan.
