    Abstract: Google 數位圖書館計畫運用其強大的數位、網際搜索力量,與擁有豐富藏書的圖書館合作,藉由掃描圖書館的館藏圖書,供使用者得以瀏覽已絕版圖書、屬於公共領域之圖書資料全文,以及尚受著作權保護之圖書資料中與使用者搜尋語詞相關的部分文句。期透過與圖書館的合作,來建立所有語言和所有圖書之完整、可搜尋、虛擬的卡片目錄,藉此幫助使用者找到新圖書,也幫出版者找到新讀者。此計畫通過策略性企業社會責任須考量的四個環境因子檢驗,不但可提升Google 的網路搜尋地位,同時又可發揮圖書館公共資訊保存及散布的重要機制。堪稱為經典策略性企業社會責任案例。然而,此一數位圖書館計畫掃描範圍除絕版圖書和公領域作品外,仍包括目前尚受著作權保護的圖書。世界各地的作者與出版者遂紛紛控訴Google 數位圖書館計畫侵害其著作權。本文分別以策略性企業社會責任與著作權合理使用原則角度,來檢視Google 的數位圖書館計畫,探討此一計畫是否達到策略性企業社會責任目標,及其適用著作權合理使用原則之可能性。最後,檢視此一Google 圖書數位化計畫商業管理模式,並提出商業利潤共享機制與智慧財產權侵權保險( IP infringement insurance)配套措施之建議。
    The Google Print Library Project scans works from major research libraries, many of which are out-of-print or otherwise inaccessible to most of the public. The ambitious goal of this project is to make the full text of all the world`s books searchable by anyone and to help users discover new books and publishers discover new readers. It’s no denying that the Google Print Library Project values to the consumer and society and deserves the classic case for strategic corporate social responsibility. This paper describes Google Print Library Project and examines the public value from the strategic corporate social responsibility perspective. In the main section, this paper applies U.S. copyright law to the library project and analyses whether the library project`s use of copyrighted works should be considered fair use. Finally, it examines the business model and proposes the mechanisms of profit-share and intellectual property infringement insurance. The library project, however, operates on passive consent, rather than express consent. The library project scans all books in the participating library collections unless copyright holders opt out of the project. By systematically copying protected works, the library project potentially infringes copyrights.
