    Abstract: 瑞士部分工時法制是採取簡易的立法模式,僅有債法第319條第2項的一項規定。透過勞動契約法的解釋,在個別的勞動條件中具體呈現部分工時勞工的「均等待遇原則」。瑞士部分工時勞動契約法制的法理,一方面可以作為我國現行法解釋的參考,另一方面,在未來如果有修法或是特別立法的可能時,也可供借鏡。本文的主要內容,首先探討部分工時勞動契約法制中,最核心的「部分工時勞工」的概念,從國際勞工組織一九九四年部分工時公約,與歐洲聯盟部分工時指導綱領的定義出發,接著探討瑞士與我國現行法制中的定義,然後提出本文的見解;其次討論瑞士學說與實務,如何依據債法中有關勞動契約的相關規定,對部分工時勞工的勞動條件加以解釋。依序討論兼職與忠誠義務、工資支付、工作時間、例假日、法定休假、特別的自由時間、不可歸責的勞務給付障礙、特別休假與勞動關係消滅等一般勞動條件,同時也討論召喚工作與工作分享的特別法律問題;第三,由瑞士法制的經驗,比較與檢討我國現行法制(特別是勞基法)對部分工時勞工勞動條件的保護內容。最後,在結論中提出我國有制定部分工時相關法律的必要,最簡易可行的立法方式,是在勞基法中,增訂部分工時勞動條件的保護規定。
    The legal regulation regarding part-time employment in Switzerland is not complicated, for there is only one subsection in Section 319 of the Swiss Code of Obligations. Although the principle of equal treatment of part-time employees is not stipulated in Swiss laws, it is realized in individual cases through the application of the Code of Obligations. The relevant principles and rules of Swiss laws may serve as useful examples both for Taiwan’s future legislation as well as court interpretations.This article is divided into three parts. The first part focuses on the definition of “part-time employee.” After comparing the definition of Swiss law with the definitions of the ILO Part-time Convention and the EU Directive on Part-time Work, it is found that the Swiss definition took a rather simplified approach which nonetheless is sufficient to resolve problems. The second part provides an analysis on the protection of part-time employees under the Swiss Code of Obligations. In principle, a part-time employee enjoys the same rights as a full-time employee. The regulations in respect of employment conditions, which include concurrent jobs, wages and other benefits from employers, working hours, paid public holidays, other paid and unpaid leave, paid annual leave, and termination of employment are considered. Special issues concerning on-call work and job-sharing are also discussed. The final part examines how Taiwan’s current laws, especially, the Labor Standards Act, protect part-time workers and how they can be revised with reference to the Swiss laws. It is suggested that adding several articles in the Labor Standards Act would serve to clarify the legal aspects of the issue.
