Title:	都市更新正當程序之解構與再建構

Abstract:	釋字第七○九號宣告都市更新條例部分條文違憲,並明確地為都市更新應踐行之正當行政程序提出相關立法標準,對於建構個別法中之正式程序,有正面意義。惟本號解釋在前提與論述中間出現落差,以附第三人效力之行政處分的思考理解都市更新事業計畫核定之性質,錯失為長期以來引發爭議之計畫法制及開發行為法制建立正當程序的良機。本文基於都市更新法律性質之理解,重新建構都市更新應行之正當程序,並提出後續行政救濟面臨之挑戰,以期未來相關法制得以更完備,而真正發揮改善居住環境、維護居住正義之功能。
