    Abstract: 民事訴訟法係一程序法規,有其所欲實現之目的,雖在學理上,於民事訴訟之目的有不同之觀察角度,但將其視為「實體權利之確認與實現」之見解,仍具有一定之重要性。基於此一目的觀,原告提起訴訟,即以獲得本案勝訴判決為其目標。但是否所有當事人所提之訴,法院均應以本案判決終結之,則涉及訴訟要件之基本功能設定問題。因法院進入本案之審理,為求慎重與正確之裁判,其所花費法院及當事人等之時間、勞力與費用甚鉅,自不應浮濫為之。因而,某角度而言,訴訟要件至少在訴訟程序上即具有其過濾與監控不合法起訴之功能。但訴訟要件之內容(種類)並非單一,其彼此間及其與本案審理間之關係,能否認為訴訟要件必先於本案審理及各訴訟要件間必存在一定之審理次序,則有不同之看法。
