Abstract:	釋字第六八九號解釋不論從程序或實體方面觀察，都在司法院大法官釋憲史上留下珍貴的紀錄。本文主要將針對本件解釋所涉及的爭點，進一步討論以下幾項議題：關於新聞自由受憲法保障所衍生的問題；憲法上隱私權概念的進一步探討；新聞自由與隱私權保護衝突的權衡；從「言論自由正當法律程序」的觀點，討論社會秩序維護法第八十九條授權警察機關裁罰的合憲性。本文希望藉由美國法制的比較觀察，釐清相關爭議，並供未來學說及實務參考。
