    Abstract: 新家事事件法的施行,一方面具有程序法上的開創意義,形塑法制史上的里程碑;另一方面,亦遭受制定過程匆促、配套制度不足,部分設計陳義過高、適用困難,立法品質不進反退等重大批評。本文以備受關注的合併審理制度為中心,藉由名法學家Aarnio所提典範理論運用在法學爭議的架構,初步分析合併審理所涉概念、體系及價值判斷的新舊法差異,以判斷爭議根源是否因典範轉換所致,造成不同典範信仰者的針鋒相對,並為相關爭議提供不同觀察脈絡。
