Title:	人事訴訟的典範轉換？！──以家事事件合併審理制度為例 /月旦法學雜誌2012年10月

Abstract:	新家事事件法的施行，一方面具有程序法上的開創意義，形塑法制史上的里程碑；另一方面，亦遭受制定過程匆促、配套制度不足，部分設計陳義過高、適用困難，立法品質不進反退等重大批評。本文以備受關注的合併審理制度為中心，藉由名法學家Aarnio所提典範理論運用在法學爭議的架構，初步分析合併審理所涉概念、體系及價值判斷的新舊法差異，以判斷爭議根源是否因典範轉換所致，造成不同典範信仰者的針鋒相對，並為相關爭議提供不同觀察脈絡。
