Abstract:	美國聯邦交易委員會於1999年In re GeoCities一案中，首度認定「業者違反其自身所公布的隱私權保護政策（privacy policy），蒐集消費者個人資料」，即構成聯邦交易委員會法第5條規定的「欺罔（deceptive）」行為。自2005年起，聯邦交易委員會更多次利用同法有關禁止「不公平（unfair）」行為的規定，進一步擴張其管制的範圍：凡「業者未充分告知其資料蒐集、處理的原則」或「業者未採行合理適當的資訊安全措施」，均被認為是「不公平」行為。相較於聯邦交易委員會的執法行動，臺灣有關機關迄今並無介入此一領域的跡象。然而，近年來臺灣個人資料外洩案件層出不窮，其中涉及業者欺罔或不公平資訊行為者，依據現有法制究應如何處理？是否有仿效聯邦交易委員會的作法，採取行政管制的可能？本文除介紹聯邦交易委員會對於資訊隱私案件所持的基本原則，以及相關的案件類型與其限制外，將進一步分析、討論在臺灣現有法制架構下，對於欺罔及不公平資訊行為的規範，以及採取類似聯邦交易委員會行政管制措施的可能性。
