    Abstract: 隨著行動通訊與網路技術的快速發展，配合網路新興商業模式不斷出現，使得商標侵權的問題日趨嚴峻，也受到各方的關切。而在網路商標侵權的各種類型中，網路服務提供者所涉及的商標侵權責任，特別是商標間接侵權責任，隨著Tiffany v. eBay，歐盟L’Oreal以及大陸淘寶網等知名網站被控間接侵權，使得有關網路服務提供者的間接侵權責任也逐漸受到各方的關注。由於商標間接侵權責任正隨著網路商業模式的不斷變化而演變，因此，本文特別針對網路服務提供者之間接商標侵權責任與相關國外案例加以探討，以對智慧財產權間接侵權責任於商標之適用方面能有更深入的介紹。
