    Abstract: 現代的代議民主，透過法的規範，在保障老百姓─不論其屬多數或少數─的自由權利方面，有其優點在，不是直接民主所得比擬的。尤其在社會內部有分歧的情況下，過度強調直接民主，對社會整體的穩定，可能會有不良的影響。依此，公民投票作為一種直接民主之機制，有其潛在之問題。然而，這樣的說法並非在排斥公民投票，而在強調一個比較穩妥同時也是多數民主國家所持有的態度與作法，即以公民投票補充代議民主之不足，而非用以取而代之。
