    Abstract: 現代的代議民主,透過法的規範,在保障老百姓─不論其屬多數或少數─的自由權利方面,有其優點在,不是直接民主所得比擬的。尤其在社會內部有分歧的情況下,過度強調直接民主,對社會整體的穩定,可能會有不良的影響。依此,公民投票作為一種直接民主之機制,有其潛在之問題。然而,這樣的說法並非在排斥公民投票,而在強調一個比較穩妥同時也是多數民主國家所持有的態度與作法,即以公民投票補充代議民主之不足,而非用以取而代之。
