    Abstract: 本文從國際組織法觀點，分四部分探討聯大二七五八號決議。首先，根據法律正當的程序(due process of law)，區分決議合法(de jure)與事實上(de facto)的效力，同時分析決議合法性的基礎與範圍。其次，以比較法的方式，分析二七五八號決議與國家主權的問題，以吾人雖可質疑決議干涉國家主權，但聯大得在憲章所賦予其權能整體架構下，決定二七五八號決議案。另外則引用國際法院有關諮詢意見論證證，憲章固然賦予聯大權能的整體架構，但憲章亦同時止聯大有愈權行為。縱然聯大的愈權行為大多數會員國所同意，但大多數會員國之同意，仍無權擴張、改變或棄憲章於不顧。最後並分析誰有資格審議二七五八號決議的問題。
