    Abstract: 台灣原住民族權利論述的發展歷程中,經常援引美國原住民相關制度和台灣相互對照,但對於阿拉斯加的獨特經驗的瞭解則是較少的。從被割讓的歷史到和經濟緊密結合的治理體制,阿拉斯加的經驗應有其值得台灣原住民加以借鏡,並進而反思自身之處境與未來可能性的地方。本文運用文獻回顧的方式,從阿拉斯加的地理環境與原住民族概況的介紹開始,進入到阿拉斯加原住民土地權之脈絡的探討,並說明《阿拉斯加原住民土地權利處理法》之內容以及實行情形,接著討論環繞著『阿拉斯加原住民土地權利處理法』與原住民族主權相關之爭議。最後,本文則指出阿拉斯加原住民族因為主權行使實體和土地權之間的切割所造成的困境,以及這樣的經驗教訓所能帶給台灣的啟發。
    The experience of indigenous self-governance in Mainland United States has been frequently applied in the discussions of indigenous rights in Taiwan. Relatively, Taiwan indigenous people are unfamiliar with the Native Alaskan history which shares similar experience of being ceded and continued pressure from the dominating society of resource exploitation. Adopting the method of literature review, this paper describes the historical, geographical and ethnic background of Alaska; scrutinizes the transition of Native Alaska land rights; and addresses the content of the Alaska Native Claims Settlement Act, and analyzes the conflicts between this act and indigenous sovereignty. In the end, this paper points out how the deprival of land rights from the sovereign subject leads to the disadvantage of indigenous people, and discusses the lesson it brings to Taiwan.
