    Abstract: 成功設計的故事角色通常具有極高的商業價值,可脫離原本的故事情節而成為獨立的商品,但是國內學術界及實務界對於故事角色是否可獨立受到著作權法保護之議題,至今仍有待討論。一般而言,以美術著作(如卡通)呈現的故事角色,由於有具體特定的形貌,因此可獲得著作權保護多無爭議;但是以文字或其他抽象方式描繪的故事角色是否能取得著作權保護,則為一仍待探討的問題,本文以比較法的觀點,參酌我國及美國著作權法實務後,肯定此等故事角色受到著作權法保護之可能性,並就相關議題、理論及標準提出初步觀察與建議。
