    Abstract: 本研究主要在闡明分析聯合國「國家及其財產管轄豁免條約」的內容與未來展望。全文首先說明公約的立法背景與歷史沿革,世界各國在公約制訂時所陳述的法律觀點,以及公約的立法方式與結構。其次則是分析公約的主要內容,尤其是著重在八種國家不得援引管轄豁免的情況,它們分別是:(一)國家與外國自然人或法人從事商業交易;(二)有關僱傭契約的訴訟;(三)涉及人身傷害和財產損害的訴訟;(四)爭議涉及國家財產的所有權、佔有和使用;(五)與知識產權和工業產權有關的爭端;(六)與國家參加公司或其他類似組織有關的訴訟;(七)與國家擁有或經營船舶有關的訴訟;(八)仲裁協定效力有關的爭端。其中,國家從事商業活動所牽連的問題最重要也最複雜,預期將花較多的篇幅討論。第三部分則是介紹公約對於執行豁免的規範,以及關於送達與缺席判決的規定,和特定種類的國家財產,如中央銀行存款和軍事用途財產的地位,最後則是做結論並提出我國應有的因應之道。
    This project is to analyze the new UN Convention on Jurisdictional immunity of States and Their Property, with emphasize on claims arising from: commercial transactions; contracts of employment; personal injury and damage to property; ownership, possession, and use of property; intellectual and industrial property; state-owned or operated ships used for other than government purposes; certain matters relating to arbitration proceedings; and situations involving consent to jurisdiction; protection from pre- and post-judgment measures of constraint, criteria for service of process and rendering default judgments. After a brief introduction, Part II provided background on the UN Convention on Jurisdictional immunity of States and Their Property, including the histories and developments of its codification by the International Law Commission. Then, part III introduced the scope and interpretation of the UN Convention, and how does it define the subjects of immunity. While part IV reviewed the specific provisions delineating the exceptions to state immunity in the Convention article by article, other issues of immunity from measures of constraint, service of process, default judgments, and other procedural rules will be dealt in parts V and VI. General conclusions derived from part II to part VI were discussed in part VII.
