Abstract:	本計畫將探討近代德國法制發展史。所謂「近代」（Neuzeit）指的是介於中世紀與十九世紀之間，德國社會從中世紀開始進入現代的時期，也是德國法制發展上的轉捩點。本計畫所討論的近代德國法制的發展主要是以西元1500年到1800年前後為主。本計畫預計將分下面二個方向來討論德國近代的法制變化：一、討論近代影響德國法制發展的幾個重要事件，二、探討近代以來德國刑法的發展史。預計在第二年再逐漸討論近代以來德國民法的發展史，及公法（以警察法為主）的發展。本計畫預定藉由回顧近代影響德國法制發展的幾個重要事件，進而探討近代以來德國刑法的發展史，尤其是被喻為德國現代刑法學之基礎的《卡洛林那法典》（Carolina）——它同時包含著程序及實體法的刑法法律——在德國刑法史上的重要性及其主要內容。最後，本計畫將嘗試去檢視並回顧中國法制在歷史中的發展與德國的不同。
