    Abstract: 金融海嘯席捲全球而造成眾多勞工失業或被迫放無薪假。就此,德國早在百年前即已實施的短工津貼,當屬一個極為重要的因應措施。在此次金融海嘯,德國因為此一制度,而得以從容對應。此一制度,在1970 年代也已見諸法國,荷蘭也在2009 年引進此一制度。如今,台灣當也慎重考慮引進並建立此一制度的必要性與可能性。在此之前,深入的學術研究,則為絕對必要。又除了德國、法國及荷蘭等歐洲國家的制度,美國的相關制度,尤其美國的部份失業給付,也是極為必要的比較觀察標的。本計畫預計在第一年進行德國制度的研究,第二年為法國與和荷蘭的研究。第三年則為美國之研究。研究的內容將包括此一制度的政策、法律以及法事實的成效評估。研究地點,除了在台灣的準備工作,尤其文獻的分析外,將前往德國Max-Planck 外國與國際社會法研究所(MPI Sozialrecht)、魯汶大學的歐洲社會安全研究所(EISS)及美國的 Brooking Institution 進行此一研究計畫,並分別與MPI 所長Becker 教授,EISS 所長Pietters 教授及Brookings Insttitution 資深研究員Burtless 博士合作。經由此一研究計畫,期望能對台灣提供詳細與精確之學術資訊,以為建立相關制度之基礎。如此,不止勞工將獲得保障,雇主,甚至整個國家與社會也得以獲益。
    Because of the global financial crisis a lot of laborers had been dismissed or enforced to suspend from their work without compensation. In response to such problem the Kurzarbeiertgeld (short time allowance) should be an efficient instrument. This model was introduced one hundred years ago in Germany, and serviced as an efficient instrument in response to the Global Financial Crisis. In 2009 Holland had introduced the German Model, and Frnce had also improved her partial unemployment benefit, which was introduced in 1970`s. For Taiwan it’s time to evaluate whether we need introduce such an institution. Then, it should be worth having a study on the legal foundation of this institution in Germany, France and Holland. In addition to the German Model, the relating experience in America, especially the partial unemployment benefit is also of importance. The first year, the study program will focus on the legal foundation and experience of the short time allowance in Germany. The second year, this program will probe the legal foundation and experience of the short time allowance in France and Holland. Lastly, this program will also observe the legal foundation and experience of the partial unemployment benefit in the US. Hopefully, through this study the social security system in Taiwan can be improved. Then, to be protected and profited is not only the employed, but the employer, and also the whole country and society.
