    Abstract: 申請人專題研究計畫題目是「從比較法觀點論我國債務不履行制度之若干問題」。以下首先說明本研究計畫所採取之研究方法,而後說明本研究計畫所挑選之各項問題。本專題研究計畫對每一年度之個別法律問題,均期望在可能範圍內依下列模式進行,即首先說明比較法之概況,而後對我國法之規定以及最高法院判決分析檢討,最後則是結論。首先,在比較法之說明中,本專題研究計畫擬首先說明英美法、德國法以及聯合國國際商品買賣公約(Convention of the International Sale of Goods, CISG)、私法統一國際協會之國際商事契約原則(Principles of International Commercial Contracts, PICC, Unidroit) 以及歐洲私法之模範規則1(Draft of Common Frame of Reference, DCFR,此一模範規則係奠基於或曾參考所謂歐洲契約法原則,Principles of European Contract Law, PECL)。其次,本專題研究計畫在進行比較法概況之說明之後,亦期望對我國法以及最高法院判決進行分析檢討。在此,將特別針對比較法概況說明所得到之各項法律原則與我國法尤其最高法院所採取之見解互相比較,分析相互間之利弊得失,探討究竟何種原則或見解較適合解決相關之法律問題。以下說明本專題研究計畫個別年度之題目。本研究計畫第一年之主題是「從比較法觀點論清償期前債務人預示不履行之問題」。又第二年主題是「從比較法觀點論債務不履行請求無益費用之損害賠償之問題。至於第三年主題是「從比較法觀點論民法債務不履行一般規定與買賣法特別規定之調合」。
    This year I would like to apply a research project for three years from 2010 to 2013 to conduct a comparative study on some problems of nonperformance and it’s remedies in Taiwan’s Civil code. My research focus will be on two parts. First part is the materials of comparative law. And the second part is analysis of legal provisions and principles in Taiwan. Then I will make a conclusion of my research. The comparative law materials I will use is Anglo-American law, German law, and international contract law principles, including Convention of international sale of goods(CISG), Principle of international commercial contracts(PICC), and the model rules of Draft of common Frame of Reference(DCFR). In addition, I will also try to mention principles of the contract law of PRC. Then I will analyze the legal principles regulated by the Taiwan’s Civil Code, including judicial judgments by the Supreme Court in Taiwan. In the first year I choose a problem about the so called prospective nonperformance by obligor. According to the materials of comparative law we know that national and international contract laws recognize some principles to deal with prospective nonperformance by obligor. But judicial judgments by the Supreme Court in Taiwan don’t take this position. I will use comparative law materials to demonstrate the pro and against of related arguments and hope that it will be helpful for us to think about which one of opinions should be prevail. In the second year I would like to explore the problem of damage of reliance interest when obligor violate its obligation to perform in Taiwan. Both Anglo-American case law and German Civil Code allow injured obligee to claim damage of reliance interest, but Taiwan’s Civil Code doesn’t give injured obligee such choice; academic opinion is also rare. I think we can benefit very much from reading Fuller and Perdue’s classic article “The Reliance interest in contract damages” and deepen our knowledge about the foundation of damages when nonperformance by obligor occurred. At the end of second year I hope I have already acquired enough knowledge about principles of damages when there has been breach by obligor. In the third year I want to inquire problems of the harmonization between the general provisions of remedies of nonperformance and the special provisions regulated in the law of sales in the second part of Taiwan’s Civil Code, law of obligation. So far as I know, such issue doesn’t arise in Anglo-American law, and German Civil Code has changed its provisions in BGB in 2002 and eliminated many problems which has arose in Taiwan. Therefore I am eager to know what such national laws have done to prevent such problems and if there is anything we can learn from them.
