    Abstract: 少年事件運用修復式司法可行性之研究伴隨著工業化、都市化的發展,資訊情報的氾濫,今日少年所面臨的社會適應問題,較過去任何時代更為嚴苛。對那些一時誤蹈法網的少年來說,少年司法體系如何能夠提供更好的處遇方式,使其能夠真摯的悔悟並能健全發展,已經是世界各國少年法制共同的目標。另一方面,少年犯罪之被害人,也逐漸走出黑暗的角落,而呼求著司法與社會更多的關注。為了能夠兼顧兩者,自1974年以來,尤其是進入1990年代後,世界各國莫不致力於將修復式司法的理念運用在少年事件上。其發展模式不盡相同,若依對話型態有被害人與加害人的調解機制、家族協商會議、和平圈(或量刑圈)等之不同;若依照其與既存少年司法制度的關係,則有互補模式、替代模式或作為量刑事由、保護管束或假釋條件等不同模式。然而可以確認的是,這股思潮使少年法制充滿更多的彈性與選擇。我國近年來對修復式司法雖不乏有文獻加以介紹,但多涉及理念層面,並僅止於成人刑事案件,嘗試將之運用於少年事件並探討法制化之可能性者寥寥無幾。這是因為一方面少年法本身有其特殊性,研究者本來不多,另一方面修復式司法在國內也屬新興思潮,兩者之結合研究並不容易。本研究擬分兩年期進行。首先進行理論深究,並同時進行法制運用之比較,以不同之修復式司法對話型態為縱軸,以修復式司法與少年司法之關係為橫軸,選取美國、與日本作為主要的比較研究對象,先檢討兩國之運用背景、實際運作方式與成效。第二階段則以此為基礎,在我國少年法之目標與法制架構下,嘗試提出少年事件運用修復式司法之具體建議,以作為法制檢討與政策之參考。
    Restorative Justice for Juveniles Along with industrialization, urbanization, and proliferation of information today, the social adjustment problems the youth face is more stringent than in the past, especially for those who breaking the law. Since it seems hard to encourage them to face the fault, how to reintegrate them into society, becomes a challenge in most countries. On the other hand, the victims of juvenile crime, has claimed for more attention from our justice system. Restorative Justice tries to reintegrate youth offenders and victims of crime. In practices, there’re different models for dialogue, like victim offender mediation, family group conferencing, and sentencing circles. About the relationship between restorative justice and juvenile justice system, there are complementary model and alternative model. Some jurisdictions also use restorative justice conference as a condition of probation. Juvenile justice system will be more flexible and thus more effectible because of the use of restorative justice. This study will focus on the United States and Japan, to see how restorative justice has been practiced, and what effects it has brought. Based on the research of mentioning above, this study then will explore how to implement reform in juvenile justice.
