    Abstract: 「非法移民」乃是近年來世界各國與國際組織,探討全球人口遷徙時的重要議題。台灣做為一個移民/移工的重要輸入國,自然也不能例外。尤其所謂「非法」的樣態與原因非常複雜,必須有細緻的法律分析。 然而,我國目前的移民政策與制度,鮮少區分各種不同類型的非法移民,而多以簡單的「逮捕、收容、驅逐」模式處理之。更未從人權之角度,細膩分辨各種不同類型的「非法」情狀,而給予不同的處理、照護,甚至修法。 與國際經驗對照,可知「非法移民」往往是國際人權規範與國內憲法保障的重要對象。但我國對待「非法」移民的粗糙態度,可能與理論及實證的欠缺有關: 一方面,決策者與執法者持簡化的「國家主權」、「法律秩序」觀,誤以為「非法」就代表完全不受保護;另一方面,在前述的輕忽心態下,我國並沒有足夠的實證資料,足以做為法制設計與發展憲法原則之基礎。有鑑於此,本研究擬補足國內有關研究之不足,發展出符合現實的憲法理論,做為保障非法移民人權之指引,且能與國際相關研究趨勢接軌。 基本上,本研究所欲解決之問題及研究之目標為— 1. 憲法上的基本權利規定,是否(或如何)適用於「非法移民」? 2. 「非法移民」在國際上,受到何種程度的法律保障? 3. 「非法移民」在我國的現況脈絡—包括法制與現實面。 4. 現行相關法令與執行,是否(如何)應做修改與調整? 本計畫目前已初步整理各國法制與政策並做成表格,同時開始訪談台灣非法移民之工作。
    “Illegal Immigrants” (undocumented immigrants or irregular immigrants) has been a critical issue when various nations and international organizations are exploring global migration in recent years. Taiwan as a host country of immigrants/ migrant workers should take this issue into account as well. Especially the patterns and causes of “illegal” are very complicated and worth subtle legal analysis. Nonetheless, the existing immigration laws and policies largely dealt with “illegal immigrants” by simple model of “arrest-detention-deportation”, they rarely treat different cases differently. Moreover, the policymakers rarely develop varying strategies, including treatment, care, or even amending laws, in terms of human rights. In comparison with international experiences, “illegal immigrants” is one of the primary targets go be protected by international human rights and domestic constitutional law. The absence of theoretical and empirical analysis of this issue might contribute to the current raw attitude toward illegal immigrants. For one thing, policymakers and law enforcement officials hold the oversimplified “national sovereignty” and “law & order” notions, erroneously exclude the “outlaws” as unprotected species; for another, there is no sufficient empirical materials in supporting sound policy, laws, and constitutional principles. Therefore, this study attempts to fill the gap and develop a realistic constitutional theory to protect illegal immigrants’ rights. Also, the result of this study must establish the connection with the relevant transnational studies. Basically, this study attempts to resolve the following questions: 1. Whether and to what extent the constitutional rights can be applied to illegal immigrants? 2. In accordance with international experiences, to what extent illegal immigrants have been protected by law? 3.The legal and empirical contexts of “illegal immigrants” in Taiwan. 4.Whether and how the current laws and its implementation must be revised? This project has started analyzing various countries laws regarding undocumented immigrants. It also started interviewing the undocumented migrants in Taiwan.
