    Abstract: 本計畫以探討分割履行契約有部分不履行之情形時,債權人得否解除及解除之範圍等問題,亦即,本計畫具體探討之課題包含債權人需在如何之要件下始得解除契約,其得解除之範圍僅限於該部履行部分、或得包含尚未履行部分、或甚至得及於已履行部分,賦予各該效果時要件上應為如何之限定,判斷是否符合此等要件之標準或要素為何,確立此等救濟方法之理論基礎為何等。研究方法上,本計畫將以對本課題有明文規定之CISG(§73)為中心,比較其與 PECL(§9-302)、PICC 等之異同,並探究與本課題有相關規定及探討之英(SGA§31)美(UCC2-612)德(BGB§281、§282、§323)日等國之發展現狀。本研究之目的在於,藉由以上比較研究所得成果,將其結合我國民法相關規定,建構解釋論上的基礎,作為解決此類型契約所生紛爭之依據。
    This research focuses on the subject concerning avoidance for debtor arises from the breach of installment contract. The important study materials will be those discussions around CISG(§73)and related norms in PECL(§9-302) and PICC. Also, those development under SGA§31, UCC2-612, BGB§281/§282/§323 and Japanese law will be researched. The comparative results above will be connected to Taiwan’s civil law system, and as a basis to be able to resolve dispute under the issue mentioned above.
