Title:	從德國新民法看醫療法修正後之法律適用

Abstract:	涉及醫療糾紛之法律，包括了民法及其他如消費者保護法及醫療法等特別法，因此對於醫療糾紛如何適用法律有其複雜性。相關之法律問題，例如，第一，有關醫療行為是否適用消保法之問題至今紛擾尚未解決；第二，醫療法於93 年4 月28 日修正後，其第82 條之規定，能否排除消保法及民法之適用，亦眾說紛紜。而該條本身，是否為獨立之請求權條款亦值探討。本計書之內容主要分三部分，第一部分為瑕疵醫療行為--德國與台灣法院實務之比較，主要就德國新舊民法處理瑕疵醫療行為之發展及醫療法上之若干法律原則，例如事實說明一切等原則在德國及我國實務上之運用等加以介紹。第二部分為德國與台灣法律上的說明義務及病歷表記載義務，主要在於分析研究我國及德國實務上就醫療行為說明義務及病歷表記載義務之討論，比較二國實務見解之異同及優缺點，並探求說明義務及病歷表記載義務應有的實質內涵。第三部分則為德國醫療糾紛調解制度與我國的醫療糾紛處理條例草案的比較，擬就德國醫療糾紛調解制度加以介紹，並與我國的醫療糾紛處理條例草案之內容加以比較，以做為修法之參考。
