| Abstract: | 隨著標準制定組織准許採用擁有專利的技術後，智慧財產權與標準制定間的關係日益密切。在此種趨勢下，國際業者的重心已經逐漸從單純的取得專利轉為控制標準。而大陸確定以國家的力量建構以自主智慧財產權為基礎的標準策略之後，未來對於標準的爭奪將會更為激烈。也因為標準與智慧財產權的結合日趨緊密，如何協調智慧財產權人與標準利用人的衝突，特別是如何平衡掌控標準的智慧財產權人標準利用者之間的權益，乃是重要的課題。而在此快速變動的大環境中，我國政府與業者實應正視智慧財產權與標準結合的趨勢與未來標準的重要，並採行積極的政策與策略，正視標準所可能產生的影響。本研究計畫將針對國際標準制定的相關機制、所牽涉的問題、以及我國所面臨之問題進行研究，並提出相應對策，供政府及業者在制定相關政策及策略時可以參酌，以使我國業者得以透過掌控標準與相關智慧財產權的模式，參與未來產品發展的契機，而不致淪為永遠的代工者。
Ever since the standard setting organizations (SSOs) permit patents can be incorporated into standards, the link between standards and intellectual property has become more complex and controversial. Along with the increasing close relationship between standards and the intellectual property, especially with the patent rights, the focus has gradually shifted from acquiring patents to controlling standards. To worse the situation, Chinese government also established a national policy regarding standards, that is, to foster Chinese national standards by employing intellectual property controlled by Chinese companies. Such policy further strengthened the fight for standards in the international arena. Due to the fact that once patents were integrated into a standard, the patent holders might legally exercise their rights against any or all users who comply with the standard. Therefore, it is imperative for all parties involved to harmonize the conflicts and balance the interests between the standard users and patent owners. Amid the hyper-competitive global environment, Taiwanese government and business not only shall pay special attention to the strategic use and the potential impacts of standards, but also the integration trend between standards and patents. This proposal, therefore, will try to explore this thorny issue from legal and policy aspects. This search project, if being granted, will not only investigate the standards setting organization and the procedure of standards setting, but will also focus on the related legal issues which deal with intellectual property and the related competition laws. Moreover, at the conclusion of the research project, the applicant will try to propose a few strategic approach in how to deal with the present challenge faces by Taiwanese business. The purposes of this research are: to help local industries in realizing the importance of the standards setting, to promote the participation of standards setting process, and, if possible, to control the relevant industry standards. |
