    摘要: 經驗法則係指自日常生活經驗綜合歸納所獲得關於判斷事實之知識或法則，其在民事訴訟法上具有重大功能，亦即，其不僅可作用於法院認定事實，尤其在對於間接事實與直接事實間充當推斷之基礎，其且可作為對於法院自由心證運作之監控機制；而其在舉證責任減輕制度中之表見證明，亦有所作用；甚至對於第三審上訴事由是否亦包括判決違反經驗法則，亦向為學說實務之關注對象。對於經驗法則之研究，其於程序法上之意義，且應注意其對於當事人程序利益之關聯性，而對於經驗法則於爭點整理及審理集中化之運作過程中之意義，即成為本文研究之主要目的。
    Erfahrungssatze sind sowohl die Regeln der allgemeinen Lebenserfahrung und Bildung als auch die Regeln einer besonderen Fach- und Sachkunde in Kunst und Wissenschaft, Handwerk und Gewerbe, Handel und Verkehr；sie teils aus der Beobachtung des Lebens und des Tuns und Treibens der Menschen abgeleitet, teils die Ergebnisse wissenschaftlicher Forschung oder einer gewerblichen oder kunstlerischen Betatigung. Sie kommen nicht nur beim Anscheinsbeweis vor, sondern sind fur jede Beweiswurdigung schlechthin unentbehrlich. In Wirklichkeit dienen sie auch der Konkretisierung von Rechtsnormen.Wegen ihre Bedeutung im Zivilprozess wendet die vorliegende Untersuchung sich der Problematik der Erfahrungssatze zu.
