    Abstract: 我國自民國十九年制訂民法親屬編後,至今經過五次實質內容之修正及一次法律用語之形式修正。其中,民國八十五年及民國八十七年之修正係大法官釋字第三六五號、第四一○號、第四五二號解釋之影響。又,大法官釋字第三六二號、第五○二號、第五五二號解釋及第五八七號解釋,亦要求有關機關對相關規定應儘速檢討修正。基於此,法務部乃就重婚問題、收養要件及子女婚生否認權提出修正草案。本文擬就民法親屬編之修正內容,論述其與大法官解釋之關係。茲就計畫要點分述如下:一、序言二、釋字第三六五號解釋對民法親屬編修正之影響三、釋字第四一○好解釋對民法親屬編修正之影響四、釋字第四五二號解釋對民法親屬編修正之影響五、釋字第五○二號解釋對民法親屬編修正之影響六、釋字第三六二號及第五五二號解釋對民法親屬編修正之影響七、釋字第五八七號解釋對民法親屬編修正之影響八、結論
    Since the enactment of the PART of FAMILY of CIVIL CODE in 1930, there have been five substantial amendments of actual article revision as well as one modal amendment of correction of usage of legal terms. Among the foregoing, amendments of 1996 and 1998 took place as a result of and were consequentially in response to the release of No. 365, No. 502 and No. 552 of J. Y. Interpretation, and No. 362, No. 502 and No. 552 of the same stated therein that the Legislation Yuan and other governing authorities shall take immediate actions to review and amend the relevant laws and regulations specified thereof. This article is intended to analyze J.Y. Interpretations in regard to the amendments of the PART of FAMILY of CIVIL CODE, with outline provided as follows: 1. Preface 2. No. 365 of J.Y. Interpretation in regard to Amendments of PART of FAMILY of CIVIL CODE 3. No. 410 of J.Y. Interpretation in regard to Amendments of PART of FAMILY of CIVIL CODE 4. No. 452 of J.Y. Interpretation in regard to Amendments of PART of FAMILY of CIVIL CODE 5. No. 502 of J.Y. Interpretation in regard to Amendments of PART of FAMILY of CIVIL CODE 6. No. 362 and No. 552 of J.Y. Interpretation in regard to Amendments of PART of FAMILY of CIVIL CODE 7. No. 587 of J.Y. Interpretation in regard to Amendments of PART of FAMILY of CIVIL CODE 8. Conclusion
