    Abstract: 現有原住民保留地制度,係沿襲日本統治時期之舊制。台灣光復初期,政府為應平 地商品化經濟之需求,乃允許非原住民的個人或企業組織申請租用或使用山區保留地從 事企業經營,然此不僅使原住民傳統知識式微,也使原住民受到平地漢人引入豐厚資金 的經濟誘因下,紛紛將土地私下轉租讓售,從而加速保留地的流失。因而,如何善用原 住民知識,並引進資金與技術發展山地經濟,以防免保留地非法流失,誠值得深入研究。 過去,保留地管理制度並未充分納入2007年聯合國原住民族權利宣言所提的財產 權、資源權與發展權等概念,誠然有所不足;目前,原住民族基本法等法規的頒行而面 臨法制的重大調整,而原住民族土地包括現有的保留地以及廣大的傳統領域,然原住民 族土地及海域法草案、原住民族自治法草案的設計,能否保障原住民族土地和自然資源 的權利,並促進資源之合理利用,尚待考察。 因此,本研究希冀以新竹縣尖石鄉泰雅族部落為例,結合永續發展、原住民知識理 論,探討目前原住民保留地管理與利用於制度面、社會面、文化面相關課題,採用實地 查勘、深度訪談等方法,瞭解原住民保留地劃設對原住民社會發展之影響,進而研擬符 合永續發展之保留地管理制度與利用措施,以保障原住民族的生存權、財產權、資源權 與發展權。
    The current institution of indigenous reserved land follows the past Japanese colonial system. After Taiwan retrocession, the government allowed non-indigenous people applying to rent or using indigenous reserved land to cope with commercialised economy in plain-land area. Whilst plain-land mass capital and technology were introduced into mountain society, it results in not only weakening indigenous traditional knowledge but also increasing the loss of the lands reserved for indigenous people because of commercialised and entrepreneurialised external incentives entering indigenous communities. To explore the reason of the loss of the indigenous reserved land, and how indigenous people can make good use of indigenous knowledge and then introduce capital and technology to develop mountainous economy for preventing the illegal loss of the lands reserved for indigenous people, are worthy to study in-depth. In the past, the establishment of the indigenous reserved lands institution merely considered indigenous right to subsistence without sufficient conceptions of property rights, resources rights and development rights that claimed in the United Nations Declaration on the Rights of Indigenous Peoples in 2007. Nowadays the domestic legal framework of indigenous people’s policy is under substantial adjustment as a result of the accomplishment of “The Indigenous Peoples Basic Law”. Although indigenous land will contain current lands reserved for indigenous people and enlarging indigenous traditional territories, the design of drafts of Indigenous Land and Maritime Space Act and Indigenous People Autonomy Act whether can they safeguard rights to indigenous land and natural resource and make reasonable use of resource are still worthy to figure out. In summary, this study attempt to take Tayal communities in Jianshih, Hsinchu County as examples to combined with sustainable development and indigenous knowledge theories, discussing management and utility topics among institution, society, and culture on indigenous reserved lands. This study will adopt fieldwork method, in-depth interview and so on. Moreover, in this study, it is essential to realise the influence of indigenous reserved lands establish towards indigenous social development, and then develop sustainable management and utility of indigenous reserved lands for safeguarding indigenous people’s right to subsistence, property right, resources right, and development right.
