    Abstract: 隨著國家與國家之間經貿關係的越趨密切,勞動權利保障與環境保護等議題也益加受到重視。尤其當許多區域經貿組織與跨國企業紛紛以勞動權利是否獲得保障為理由做為經貿往來的判斷依據時,勞動權利在我國實踐的狀況如何,著實令人關注。在諸多勞動權利中,本計畫只針對國際勞工組織所楬櫫的「國際核心勞動基準」,即「組織結社自由與團體協商」、「歧視禁止」、「強迫勞動禁止」和「童工僱用禁止」等四項做為評析的標的。藉由問卷調查與專家參與等方法,瞭解前述四項「國際核心勞動基準」在我國實踐的情形,以期做為有關政策或法制調整與修正的參考。言而總之,本研究的主要目的有以下五項:(1)針對「組織結社自由與團體協商」勞動基準在我國實踐狀況進行評析;(2)針對「歧視禁止」勞動基準在我國實踐狀況進行評析;(3)針對「強迫勞動禁止」勞動基準在我國實踐狀況進行評析;(4)針對「童工僱用禁止」勞動基準在我國實踐狀況進行評析;(5)就評析結果,提出政策制訂或法制調整建議,以落實國際核心勞動基準。
    With the increasing trade relationship among nations, issues on labor rights and environmental protection have also been continuously brought up. In particular when many international trade organizations and multinational corporations use labor rights protection as a criteria of trade relationship, whether labor rights protection has been fully implemented in Taiwan has become a concern of great importance. Under this circumstance, this research project would aim at analyzing whether four "international core labor standards" have been fully implemented or not. Through the use of questionnaire survey and expert participation, the implementation of such "international core labor standards" as "right to freedom of association and collective bargaining", "prohibition on discrimination against employment", "prohibition on forced labor" and "prohibition on child labor" will be fully analyzed. Furthermore, the result of analysis will be referred to the government for labor policies making and revision. To sum up, this research project is intended to complete the following objectives: (1) Analyzing whether the core labor standards concerning "right to freedom of association and collective bargaining" has been implemented in Taiwan. (2) Analyzing whether the core labor standards concerning "prohibition on discrimination against employment" has been implemented in Taiwan. (3) Analyzing whether the core labor standards concerning "prohibition on forced labor" has been implemented in Taiwan. (4) Analyzing whether the core labor standards concerning "prohibition on child labor" has been implemented in Taiwan. (5) On the basis of analysis results, making suggestions to the government for labor policies making and revision.
