    Abstract: 第六二七號解釋的真正問題在於程序,大法官受理明顯不合法定要件的聲請,不僅牴觸了司法與其他權力的外部分權原則,同時也顛覆了司法體系內部解釋與審判的分權原則。我國司法內部的分權不在「憲法歸大法官,法律歸法院」,而在「抽象解釋歸大法官,具體適用歸法院」,因此一旦已經有具體個案進入法院,便應由法官對該個案的憲法問題作成憲法判斷,總統免訴究特權範圍的解釋問題既已形成個案爭議,就像過去許多民意代表言論免責的爭議一樣,當然應該完全交由承審法官去做決定,其見解縱有不當,也還有上級法院去糾正,大法官不可假解釋之名行干預審判之實。
