    Title: 修憲後選區劃分法制問題之研究

    Abstract: 有關現行立委選制變革的提議中,選區重劃的工作是改革的起點,但卻是影響選舉制度改革成功與否的重要因素,原有複數選區的選舉疆界修改成以單一選區為主的選舉疆界之後,對整個選舉過程的內涵,包含選民、候選人、政黨、甚至是競選過程中的議題呈現,都將帶來不同的面貌。過去的研究對此一主題的探索相對不足,本研究企圖針對選區重劃在法律與制度層面的各項問題提出較為完整的討論,除了對選區名額配置與選區劃分問題進行制度面的討論之外,也針對各種不同型態的選區重劃委員會之組成、運作方式、以及相對應的選舉法規之修訂等問題進行分析。並藉由其他國家的經驗來看選區重劃的各項問題,透過這些經驗的取得,尋求一套適合台灣的選區重劃模式。在研究方法上,將以文獻探討與專家訪談為主。文獻探討方面,主要著重在資料蒐集與分析比較,瞭解相關的學術理論,尤其是審視先進民主國家在此方面的經驗;在專家深度訪談部分,透過個別訪談或座談的方式,瞭解選區重劃的各項因素與推動過程,尤其是在法制規範的設計、常態性選區疆界重劃的問題、甚至是司法體系在其中所扮演的角色評估等,及早進行評估,以做為台灣選區重劃委員會組成後的運作參考。 Among the current electoral reforms, redistricting is a starting point and a significant factor affecting the success of reforms. Once the new single member district is put into effect, the electoral boundary will bring in different competition structures to voters, candidates, parties and even the issues presented in elections. Unfortunately, it is relatively rare in Taiwan to find studies on this subject. This project aims at presenting a comprehensive discussion of electoral redistricting from legalistic and institutional perspectives. In addition to the institutional arrangements of apportionment and redistricting, it further explores the various types of redistricting commissions in other countries. The compositions, operations, and political consequences of these redistricting commissions will be examined. These experiences are valuable for Taiwan to find an optimal way of electoral redistricting. Methodologically, this project combines both comparative literature studies and in-depth interviews. In terms of comparative studies, it will thoroughly collect and examine relevant literatures on electoral redistricting. The experiences of advanced democracies will be provided. In in-depth interviews, it will engage in interviewing several experts, either in academic circles or in government, who seriously engaged in the topic and process of electoral redistricting. In particular, legal designs of redistricting commission, routine redistricting issues, and even the role played by the court will be examined and evaluated. These will be valuable reference for electoral redistricting in Taiwan.
