    Abstract: "證人於司法警察(官)面前所為之陳述,無論依直接審理原則或傳聞法則,原則上不具證據能力,因而依嚴格證明法則,法院不能以此證人陳述作為被告有罪判決之依據。國內實務一般所稱之警訊(詢)筆錄,本屬此種不具證據能力之證據,但早期實務一貫見解,仍承認其有證據能力。學說則反對如此見解。晚近最高法院數個指標性判決,則明白指出該等證據無證據能力。據此,無論依學說或實務,排除警訊(詢)筆錄之證據能力,似為國內通說。"
