    Title: 傳聞法則之同意

    Abstract: 刑事訴訟法第一五九條之五第一項基於當事人同意而排除傳聞禁止規定,大多於第一審法院適用,於上訴審(第二審及第三審),適用案例不多;於第二審及第三審,較多是適用本條第二項擬制同意情形。不過,法院認定適用本條之案例中,對於同意之主觀前提要件「知」有傳聞證據,沒有判決於判決理由內曾提及過,甚而只要被告於法院調查證據時,表示無意見,即被法院認定有本條第二項之適用。如此判決皆有適用本條規定不當之嫌。本文嘗試依刑事訴訟法理,分析判斷本條規定之同意及擬制同意之程序法性質,進而就本條規定之程序要件予以闡釋說明,並就規範不足之處,提出適用之建議,冀圖對未來實務適用有所助益。
