Title:	從拘束力觀點論協商程序

Abstract:	刑訴法第四五五條之二第一項所規定之協商事項,雖可分為「量刑協商」(第一款)及「負擔協商」(第二至四款),但前者始為協商程序之實體核心。當事人對於協商事項所為之協商合意,對於當事人及法官,現行法各別有不同程度之拘束力規定;前者有第四五五條之三第三項規定,後者有第四五五條之四規定。本文除解釋各該規定之外,亦分析幾則地方法院之協商判決內容,尤其是對於判決所提之沒收、累犯等主文宣告及連續犯事實之認定,皆有值得注意之處。最後,本文認為,法官應有積極參與協商之必要。
