    Abstract: 本研究係以二○○三年六月五日立法院三讀通過,同年十二月一日施行之「警察職權 行使法」第二章(第6-18 條)中,最具資料蒐集核心意義之條文為第9-13 條,為本研究之對 象,各條要旨如下: (1). 集會遊行之攝影、錄音(第9 條) (2). 公共場所或公眾得出入之場所裝置監視器(第10 條) (3). 對無隱私或秘密合理期待行為或生活情形之監視(第11 條) (4). 遴選治安人員以外第三人秘密蒐集資料(第12 條、第13 條) 在資訊時代下,人民對資訊自決(主)權或資訊隱私權保障之期望甚殷,警察基於治安 亦須擁有上述職權,兩者間之緊張關係應予調和,該研究主題,即饒富意義。 本研究之主要目的如次: (1). 警察資料蒐集權涉及人民資訊自決權或資訊隱私權,其內涵與作為基本權利相 關理論之探討。 (2). 探討警察行政危害防止與刑事危害(犯行追緝)間之「犯罪預防」領域。釐清介 於刑事與行政領域中衍生諸多法理與實際問題。此問題困擾警察法理論與實務界甚久, 公法學界對此亦甚重視,有必要深入研究。 (3). 除個人資料保護、警察犯罪預防等理論闡明外,擬以逐條釋義的方式,詳細評析 警察職權行使法第9-13 條,以供警察法學研究與實務參考。
    This study aims at charting the second chapter (ss. 6-18) of "Police Duties Enforcement Act", which was enacted on 5 June 2003 and was implemented on 1 December 2003. The main 91/10/30 修訂 content of the chapter is as follows: 1. Videotaping and Recording in the Assembling and Parade; 2. Installment of Video Surveillance Equipment in the public place; 3.Surveillance under no reasonable expectation of privacy; 4.Selection of an informant to collect data clandestinely. Public concerns about right to informational self-determination or information privacy have arisen in the information age. On the other hand, police must have these powers to maintain public order. Thus, it is crucial to explore how to reconcile the growing tension between privacy interests and law enforcement objectives. The main purpose of this study is 1. To explore the basic principle of right to informational self-determination or information privacy as human rights; 2. To clarifying the distinction of policing between criminal law and administrative law; 3. To analyze the provisions of the second chapter article by article and to introduce the theories of data protection and crime prevention. It is hoped that this study can provide a comprehensive guide to police study and practice.
