    Abstract: 在過去十年台灣的社會安全法制，尤其1995 年制訂全民健保法之後，有極為明 顯的成長現象。經由此等立法，國家的定位、社會的結構、人民的生活方式也 皆有極大的變化。隨著此等法發展，台灣的司法也必須命零新的案件類型，而 必須加以回應。其中，以司法院大法官會議為例，在過去六屆大法官會議中與 社會安全法制，尤其與社會保險有關的解釋共有二十五件，其中為第六屆大法 官作成之解釋即佔十五件。若加以進一步分析，其中為公務人員保險者計有三 件，勞工保險者為四件、全民健保者為五件，農民健康保險者為一件。這些解 釋作成之後，對於今後的立法、行政、司法將有極微極為明顯與深遠的影響。 就此等解釋加以學術分析，可說已是刻不容緩的工作。研究的標的首要為此等 解釋的分析，亦即探個別解釋的合理性。其次，則嘗試將個別解釋所揭示的原 理原則加以體系化，以推演出大法官會議的基本立場與觀點。此外，則應探討 此等解釋對於立法、行政、司法實務的影響。最後，則復應探討此等解釋對於 台灣的國家定位，尤其何等意義的民生福利國家，台灣社會安全法制的發展。 本計畫將特別強調比較研究，尤其經由德國、瑞士等國有關的憲法規定與憲法 解釋之比較研究，來探究第六屆大法官會議有關解釋的合理性與問題所在。
