    Abstract: 法院判決、無論其為一審、二審或終審，於我國現制下，除經列為判例者外，對同類事件之審理雖不具拘束力，惟判決終係法官就個別案件適用法律、決斷事理所為之見解表達，就抽象之法律規範賦予具體之意涵。因此，判決之分析與歸納，不僅可促進對法律之瞭解，增補法律規定之不備，並能為當事人之權義提供更為週詳之界定。本書作者細心蒐集自民國四十九年以後三審法院就保險事件所為較具參考意義並有助於法則形成之判決，加以梳理、整編、摘要、註釋、研討、分析、歸納、附列相關法規；進而與英、美、德、日等國同類法規與成例比較，藉以確立法院見解之權威性，充實保險法規之具體內涵，深化對保險制度應如何運作之瞭解，促使『相同事實，相同判決』目標之達成，任何保險交易中所可能發生之分爭得按當事人之認知與預期獲致合理解決。
