    Title: 加入WTO與開放外國專技人員政策之研究

    Abstract: 烏拉圭回合談判結束後,服務貿易總協定(GATS)正式成為規範服務貿易之法規,雖相關研討甚多,但有關專業服務之論著,並不多見。WTO即將展開二000年新回合服務貿易諮商,為儘快排除入會障礙,並配合我國發展為亞太營運中心之目標,對於GATS所規範之專技人員服務,亦應詳細評估討論。 本研究擬探討下列問題: 一、諸論 二、專技服務之範疇、特性及貿易障礙 三、WTO專技服務之相關規範及未來趨勢 四、WTO會員專技服務開放之分析 五、我國專技服務開放之分析 六、我國未來專技服務法規調整之方向 七、結論與建議 The General Agreement on Trade in Services (GATS) provides for the first time a rules-based multilateral framework for liberalization of trade in services through all modes of delivery. There are at present few studies on trade in services in the context of professional services (including legal, accounting, auditing, book keeping, taxation, architectural, engineering, medical, dental, quasi-medical services and veterinary services as defined in cpc). Against these background the study on a number of key issues on the professional services marks the significancy particularly before the reopen of negotiations on services in the 2000. The present study will examine the role of the professional services, in doing so, it will analyze the importance of the rules provided both by WPPS and WPDR. The structure of the study is as follows: Chapter 1 introduces the scope of and analysis adopted in the study Chapter 2 discusses the rules relating to professional services and the impacts on both service provides and services consumers Chapter 3 defines the scope、characteristic of the professional services and the trade barriers involved Chapter 4 examines various national schedules : the extent and depth of negotiated commitment Chapter 5 devotes to the deregulation on professional services Chapter 6 Discusses the deregulation concerning the movement of natural persons as professional service providers and discusses some of the ways in which the constraints could be overcome Chapter 7 briefly recaptures the earlier discussion and concludes by suggestions
