    Abstract: 本文主張,憲法應保障某些外國人的「公民權」,也就是「政治參與」之權利——包括政治表現與集會結社自由、政治性較低之服公職權、地方層級的選舉權與被選舉權,以及其他不直接涉及國家主權之政治權利。憲法賦予「外人公民權」的理論基礎包括:一、憲法文義並未全然排斥外國人享有政治權利;二、某些「外籍人士」實際上與台灣這個國家有著非常密切的連結與依賴關係(如:女性婚姻移民),實際上乃是「我們台灣人」的一份子,值得擁有「成員基本政治權利」;三、被統治者與納稅者應享有一定的參政權;四、外國人往往可能是結構性的弱勢群體,以及五、有限度的外人參政權,與國民主權並不當然牴觸。
    This article argues that the Constitution should guarantee certain aliens’ “citizenship” or rights of “political participation.” Those rights at least include the right of political expression, the right to assembly, the right of association, the right to be a public official that is non-political in nature, the right to vote in local elections, the right of access to the ballot in local elections, and other political rights not directly involving national sovereignty.The theoretical grounds for the constitutional “right” of “aliens’ citizenship” include the following: (a) the text of the Constitution does not exclude aliens’ political rights; (b) certain “aliens” (e.g., marriage female immigrants) in reality have a very close relationship and mutual reliance with Taiwan so as to make them part of “We the People of Taiwan”; (c) the people governed by the state, as well as taxpayers, must be entitled to enjoy certain rights of political participation without regard to their nationality; (d) aliens are largely the systematically disadvantaged groups; (e) to confer a limited right of political participation to aliens is not necessarily repugnant to national sovereignty.
